MINUTES OF THE PLANNING & ZONING MEETING

OF THE

MAXATAWNY TOWNSHIP BOARD OF SUPERVISORS

WEDNESDAY, AUGUST 10, 2011                     

Members of the Maxatawny Township Board of Supervisors met for the regular monthly Planning and Zoning Meeting on Wednesday, October 12, 2011, in the Township Building.  Chairman Allen L. Leiby called the meeting to order at 7:30 p.m. with Supervisors Gayle P. Sanders and David R. Hoffman present.  Also in attendance were Solicitor Jill Nagy, Engineer Chris Falencki, CEO Chris Paff, Zoning Chair Louis Hinkle, Traffic Advisor Dan Hinkle, MTMA Member Michael Berger Township Manager Justin Yaich.   

ACTION ON MINUTES

                No action to be taken on minutes for September since the meeting was cancelled. 

                Motion to accept the minutes of the August 10th Planning and Zoning Meeting was made by Supervisor Hoffman, seconded by Supervisor Sanders, and approved by all members.               

REPORTS 

1.       Code Enforcement Officer – Chris Paff

a.)     Updated the Board regarding the status of the APEX parking lot expansion.

b.)     Informed the Board regarding the recent digging in the drainage basins at Arrowhead.  All permitting on that matter is being done through the County.

c.)      Woodbridge Golf Course is having shale removed from their location.  However, disturbance is not large enough to mandate a permit be issued.

d.)     Folk Road is in need of line painting.

e.)      Supervisor Hoffman has requested Chris Paff to investigate mud on Christman Road. 

2.       Sewage Enforcement Officer - Carl Wolfe

a.)                 Nothing to report at this time 

PLANS TO REVIEW               

1.       Leiby Farms – John O’Neil presented updated plans on behalf of the Leiby Farm Subdivision.

        Engineer Falencki and Mr. O’Neil recapped the Planning Commission meeting as well as the         waivers that were recommended for approval at that meeting.       

·         On a motion by Supervisor Hoffman, seconded by Supervisor Sanders, and approved by all members, the following waivers were approved.

-          Section 214

-          Section 302.1.H

-          Section 402.3

-          Section 404.1.C

-          Section 408

-          Section 409

-          Section 502.2 and 502.3

-          Section 502.4

-          Section 502.9

-          Section 503.1 & 503.2 

·         On a motion by Supervisor Hoffman, seconded by Supervisor Sanders, and approved by all members, the plan was approved conditioned on meeting the requirements of Engineer Falencki’s letter dated 9/15/2011 and payment of all outstanding bills. 

2.       Harding Subdivision – Sketch Plan for Record – Engineer Bill Beitler and Dave Harding

        represented the plan.   

·         On a motion by Supervisor Hoffman, seconded by Supervisor Sanders, and approved by all members, the plan was approved conditional upon meeting the requirements of Engineer Falencki’s letter dated 9/15/2011 and payment of all outstanding bills. 

3.       Kutztown University Schaffer Auditorium – Final Land Development – Engineer Anne

        Anderson and Jeff Grim presented the plan on behalf of the University. 

                                Engineer Chris Falencki had several requests.

a.)     All requirements of Engineer Falencki’s letter of 9/15/2011 be satisfied

b.)     An additional page be added to the plan for site lighting

c.)      Improvements to Luckenbill Road 

University Representative Jeff Grim stated that the University would repair the base of Luckenbill Road and then resurface the existing cartway. 

·         On a motion by Supervisor Hoffman, seconded by Supervisor Sanders, and approved by all members, a waiver of section 310.C.2.F (Fencing) was granted.

·         On a motion by Supervisor Sanders, seconded by Supervisor Hoffman, and approved by all members, the plan was approved conditioned upon Engineer Falencki’s above comments, letter dated 9/15/2011, and payment of all bills. 

4.       The Borough of Kutztown – W.W.T.P. – Final Land Development Plan – Engineer Larry         Grybowski represented the plan for Kutztown.

                        According to Engineer Falencki, the plan was brought back to the Board after final approval in order for the Board to authorize a note to be place on the plan that the proposed road is to be used as a private road only.  Engineer Falencki and Chris Paff will work out the wording for the note. 

·         On a motion by Supervisor Hoffman, seconded by Supervisor Sanders, and approved by all members, the Township professionals were authorized to have the note placed on the plan. 

5.       APEX Parking Lot Expansion – Engineer Falencki presented the Board with a letter date

        October 12, 2011.  He explained to the Board that APEX needed to change the         grading at a drainage basin and outlet pipe in order to get proper flow.       

Solicitor Jill Nagy explained to the Board that APEX would be offering a deed of dedication for the right of way on College Boulevard. 

·         On a motion by Supervisor Sanders, seconded by Supervisor Hoffman, and approved by all members, the Board accepted the deed of dedication conditioned upon the release by the mortgage company. 

GENERAL BUSINESS 

                1.        Christ DeLong United Church of Christ – A request was made for signs to restrict pet owners from walking their pets on church property.  The church would like to have the Township purchase the signs and the church will then reimburse the Township. 

·         On a motion by Supervisor Sanders, seconded by Supervisor Hoffman, and approved by all members, the Board authorized the Roadmaster to purchase the signs and the Manager to bill the church for the same. 

PROFESSIONAL SERVICES 

                1.                Engineer – Chris Falencki reported the following: 

a.)     Reviewed Richmond Township’s SALDO and has no comments. 

           Solicitor – Jill Nagy gave an update on the following: 

a..)     There are some deficiencies in the Berks County Cell Tower Zoning Application.   She would like permission to draft a letter to Berks County regarding the same.

b.)     Cedar Shopping Centers will need a traffic study and traffic control device, which the Township must make application for.  Solicitor Nagy would like a full upfront deposit of escrow funds to cover the cost of traffic light since the Township will be responsible to complete the light, regardless of what happens with the development. 

·         On a motion by Supervisor Hoffman, seconded by Supervisor Sanders, and approved by all members, the Board authorized Solicitor Nagy to draft a letter to the County as she requested.

·         On a motion by Supervisor Sanders, seconded by Supervisor Hoffman, and approved by all members, the Board authorized the Township Manager to execute the traffic control contract, once the Township professional all agree that esrow and other matters are in order.
